The ScrapLab Design Contest is offered and hosted by HYVE AG and HYVE Innovation Community GmbH (“HYVE”), Schellingstr.45, 80799 Munich, Germany. HYVE is an innovation agency, specialized in the integration of customers into the product development process and the development of co-creation and community platforms. 2. Contest & Platform Goals
The main goal of the contest is generating creative and sustainable designs made of scrap. The objective is to recycle waste materials in the form of new products such as furniture, accessories or artwork (all in all 9 different categories) and to bring them back into the economic circle. It addresses everyone all around the world who is interested in how waste materials can be recycled. Besides, participants can also actively take part by voting for the best designs of other members or commenting on submissions and leaving messages.
The contest targets every person who wants to participate in this campaign. The minimum age for the participation is 18 years at the time of submission. Prospective entrants must first register and accept the Terms and Conditions before submitting any of their designs. Employees of HYVE are not eligible to receive one of the prizes announced under article 5.
In order to be able to participate in the contest, participants must register on the contest platform at www.scraplab-contest.com. On this registration page, participants must indicate and confirm at least a username, a password, their first and last name and a valid e-mail address, that they have read the conditions of participation and agreed with them.
4. Design Requirements
To participate in the contest the following steps should be taken into account:
Designs may be photos or other visualizations of existing prototypes. Furthermore designs can be either created by computer-generated programs or drawn freehand.
The images must be converted to JPG, GIF or PNG format for uploading to the website with a minimum resolution of 500 by 500 px. The file size must not exceed 5 MB.
Additional material can be uploaded in form of images (JPG, GIF, PNG, IGS, STP, 3DS, VRML) or documents (DOCX, PDF, XLSX, PPTX, TXT, CSV). Additional files may not exceed 5 MB.
It is possible for participants to submit any number of independent designs. Scrap designs may take any format to any category but must incorporate waste materials. Each submitted design must include a title, a picture, a short description and a chosen category.
5. Selection of Winners
All submitted designs have the opportunity to win cash prizes amounting to a total of 2,000 EUROS:
First prize: 1,000 EURO*
Second prize: 600 EURO
Third prize: 400 EURO
* Participants who have selected a specific kind of 1.prize when filling out the registration form may also get the according non-monetary prize.
The winning designs are determined by a professional jury made up of international experts and designers.
The jury is composed of an international group of experts and designers. The members of the jury will consider the opinions of the community, nominations made by the HYVE expert team (comprising of design and business experts from HYVE), and the evaluation criteria (Overall impression, Elaboration of design, Feasibility, Sustainability, Creativity in the utilization of scrap materials).
The jury’s decision is final. The evaluation of the individual designs as regards to the evaluation criteria will not be published. The participants have no claim to individual feedback or any explanation concerning the jury’s decision.

7. Copyright and right of use
The intellectual property rights will remain with the designer.
With the submission of a design to the competition the participant grants HYVE free of charge the exclusive, irrevocable, transferable and with regard to content, duration and area (territory) unlimited right of use to duplicate, disseminate, send, perform, make available to the public, including but not limiting to present the designs at exhibitions and fairs, in publications, in promotion- and PR materials, in printed material and in the World Wide Web. For this purpose the participant of the winning designs must provide the design as high-resolution graphics (300 dpi). In addition, HYVE reserves the right to produce the winning designs in prototype format, which will not be used commercially.
8. Originality of the designs
The participant confirms, that the designs submitted must be original and emanate from the participant themselves. They must be unpublished and produced expressly and solely for the competition itself. They must also not have won any previous award or been submitted in any other competition. All submitted designs must not be protected by copyright- or other rights and/or infringe upon a right of third parties. This includes copyrights, logos, trademarks, trade names or proprietary rights. The copy of designs from other sources is not allowed. Any form of copy will lead to immediate disqualification. The participant shall indemnify and hold harmless HYVE in the case of any infringement of a right.
9. Publication of designs
Participants who contribute their designs to this online platform accept that all submitted designs and comments will be published in the World Wide Web and will be available to an infinite number of users. Participants further agree to the publication of their names if they are chosen as Winners. Participants waive any claims to royalty, right or remuneration for the use as described in this Article. All personal data will be held strictly confidential. The organizer of the competition reserves the right to edit or delete contributions on the website without any explanation, for example, if they include any racist or sexual content or if they are considered harmful to young persons.
10. Data protection
Personal data concerning the submission of designs will only be used for administration purposes and for the evaluation of the results. All personal data will remain confidential and will not be revealed to any third parties. In case you agree with your registration to be informed by HYVE about further Idea and Design Competitions via email, you agree with the collection, processing and use of your personal data for this purpose. The personal data will be stored at HYVE and will be handled according to the regulations as stated by the German data protection law. We are engaged that all customer data will be handled as confidential and we demand the same in writing from any contractors and/or cooperation partners. It is possible to contact HYVE (Schellingstraße 45, 80799 Munich, Germany) at any time to request the deletion of all personal data.
11. Exclusion of liability
Participants warrant and represent that their materials are original to them and that they have the right to assign the rights or to grant the licenses free from any and all encumbrances and third party rights.
By entering the contest, participants agree to release and hold HYVE harmless from any and all losses, damages, claims, rights, liability and actions of any kind brought against HYVE in connection with the materials made known to HYVE in the contest, or from acceptance, possession, participation, or use of any prize, or their breach of the foregoing warranties and representations including and without limitation, personal injuries and death, as well as property damage and claims based on publicity rights, defamation, or invasion of privacy. The foregoing liability shall be restricted to acts of gross negligence and intent except for personal injuries and death.
HYVE is not responsible for entries not received due to lost, failed, delayed or interrupted connections or miscommunications or other electronic malfunctions, or due to lost, late, mutilated, illegible, incomplete, insufficient postage or misdirected mailed entries. HYVE is not responsible for incorrect or inaccurate entry information, whether caused by persons entered at the web site or by any of the equipment or programming associated with or utilized in the contest or by any human error which may occur in the processing of the entries in this contest.
Most of the content posted on the platform is provided by third parties. Such third-party content is the sole responsibility of the person creating that content. HYVE does not control, and is not responsible for this third-party content. HYVE does not warrant or guarantee the accuracy, reliability, completeness, usefulness, non-infringement of intellectual property rights, or quality of any content. The participant expressly understands and agrees that he or she bears all risks associated with using or relying on that content.
The contest web site may contain links and references to the web pages of third parties. HYVE shall have no liability for the content of such web pages and does not make representation. HYVE does not have control over the information or contents on such web pages. Neither shall HYVE be liable for the quality, correctness or completeness of any third party information expressly provided on the contest web site as third party information, including any information supplied by any of the sales partners.
It is the sole responsibility of the winner to pay taxes or other charges in conjunction with the acceptance of prizes. Acceptance of a prize in conjunction with the idea contest is subject to the applicable statutory provisions and official regulations.

* It lies within the discretion of HYVE to exchange or substitute prizes.
* If for reasons outside of the sphere of influence of HYVE an award cannot be granted, a substitute prize of equal value will be granted.
HYVE reserves the right to change these terms and conditions of participation at any time without announcing this in advance and/or to interrupt, discontinue or cancel the design contest without giving reasons and without assuming any liability. HYVE also has the right to exclude a participant from participation at any time and without assuming any liability if the participant fails to adhere to the terms and conditions of participation.
13. Applicable law
These terms and conditions shall be governed by, construed, and enforced in accordance with the laws of Germany, without regard to any choice of law principles. The participant hereby agrees and irrevocably consents to submit to the exclusive jurisdiction and venue of the courts of Munich, Germany, for any and all claims arising from or related to the contest.
